The use of this website and/or our web service(s) is covered by sections within our Terms and Conditions set forth below and are entitled: General, Valuations, Use of musicMagpie, Your Personal Data, Privacy Policy and Copyright. You understand, accept and agree that any and/or all use this website and/or our web service(s) is expressly under the Terms set out in these named clauses/sections only.

In order to sell your unwanted items on musicMagpie you will be asked to accept and agree to the following Terms & Conditions by ticking the box marked "Tick to Accept Terms & Conditions" to affirm that you have read, accept and agree to be bound by these Terms and Conditions when completing your transaction and selling your items. If you do not accept and agree to be bound by these Terms and Conditions you will be unable to sell your items on musicMagpie.

Please ensure that you have carefully and thoroughly read these Terms and Conditions before selling your items on musicMagpie. We also recommend that you retain a copy of these Terms and Conditions for your records.

General

The contract between you and musicMagpie is formed when you complete your transaction on musicMagpie, by way of submitting your order to us. You will be presented with a “thank you for completing your order web page/screen” at the point you have completed a transaction. Subsequently you will receive a “thank you for completing your order” email from us to act as a secondary method of confirmation that you have completed a transaction.

You may not transfer, assign, charge or in any way dispose of this contract or any of your rights or obligations arising under it, without our express written prior consent, which may be electronically communicated by way of email.

We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract at our discretion.

musicMagpie is for the use of UK and Channel Island Residents Only.

You are the legal owner or have permission of the owner to sell the items through musicMagpie.

You are at least 18 years old; or if you are under 18 years of age, that you have obtained
your parent’s or guardian’s consent to sell your items to us for the sum indicated on our website and you and your parents/guardians release us (‘musicMagpie’) of any liabilities or claims that may arise if you send your items to us in breach of this warranty.

Once we have received your items, checked them and dispatched payment for them to you, then ownership of the items passes immediately and irrevocably to us.

Valuations

When selling your items, payment is made based on the value offered at the time of transaction only and is subject to your items passing our quality checks (during our quality assessment process). Some of the quality checks, depending on the individual items you have decided to sell will include us checking the condition and/or description of the item you have provided are assessed as the same by us when grading/checking your items individually.

musicMagpie’s valuations for products are the express property of the Company and the data for such valuations remains in their entirety vested in the Company. You agree, confirm and warrant that by valuing items on musicMagpie’s websites or mobile applications that you are a member of the general public and NOT a business, organisation, cooperative or trader (whether sole, market or otherwise).

You expressly understand, accept and agree that musicMagpie’s pricing for products (the valuation(s) or offer price(s)) shall not be used by you on any other website(s)/mobile application(s) or on price comparison websites/services; And that you will use musicMagpie’s valuation service to value (derive offer prices) for items that you own and are considering selling to musicMagpie only. No other use of musicMagpie’s valuation services are allowed, without question, at the sole discretion of musicMagpie.

musicMagpie is NOT intended for, nor has it been developed for use by businesses, organisations, cooperatives or traders (whether sole, market or otherwise) who wish to sell single or multiple copies of the same CD, DVD, Blu-Ray, Game or tech and/or electronic product(s).

Businesses, charities, schools or other organisations should contact musicMagpie's enquiries team for alternative schemes by emailing enquiries@musicMagpie.co.uk.

Any use of musicMagpie by businesses, organisations, cooperatives or traders (whether sole, market or otherwise) that are not authorised in writing by musicMagpie may result in these Accounts being blocked/barred and any goods that we have paid for the shipping of only being released back to the unauthorised business, organisation, cooperative or trader (whether sole, market or otherwise) upon payment of administration charges to musicMagpie. Administration charges shall be of the amount and size as determined by musicMagpie at its sole discretion. You also accept and agree that NOT in all cases will musicMagpie be able to return unauthorised goods to unauthorised businesses, organisations, cooperatives or traders (whether sole, market or otherwise) regardless of the unauthorised business, organisation, cooperative or trader (whether sole, market or otherwise) making payment of an administration fee to musicMagpie and in these cases you accept and agree that musicMagpie may dispose of these goods at no charge to musicMagpie and to fully and without question indemnify musicMagpie against any loss, loss of profits, damage or liability whatsoever and howsoever arising from a breach of these Terms and Conditions.

musicMagpie will automatically reject transactions which contain multiple items of the same CD, DVD, Blu-Ray and/or Game title and reject repeat transactions that contain the same CD, DVD, Blu-Ray and/or Game titles/items that have been traded before by a user. These CD, DVD, Blu-Ray and/or Game items will not be paid for, not returned and will be recycled responsibly. Only one account per person is allowed.

You understand, accept and agree that musicMagpie will ONLY ever honour valuations that it generates and provides. No other valuations by method or source e.g. including but not limited to, any other person, organization, entity, system or website will be accepted or honoured by musicMagpie. musicMagpie’s valuation of the item which is generated as an ‘offer price’ on its webservice(s) and such ‘offer prices’ are traceable to their creation point within musicMagpie’s system is final, at musicMagpie’s sole discretion.

Selling Your Stuff - General Conditions

When selling your items to us, you do so under these Terms and Conditions only. The information that you provide to us about your items when valuing and selling your items may affect the price offered for these items. Please ensure that you accurately provide information relating to the items that you want to sell. For example, with a CD, DVD or game when you enter the barcode number into our system to get a valuation/offer price by not entering the correct barcode number this will provide a different offer price because it will be for ‘a different item’ and not the one you want to sell.

For items that fail the Quality Assessment Process or that have not been included in your relevant online transaction e.g. they have not been valued using musicMagpie’s online valuation engine which is provided on our webservice(s), website(s) and mobile application(s) and made up part of the sale you have submitted and agreed to these items cannot be returned under any circumstances and will be recycled responsibly. You also understand, agree and accept, that once your items are in TRANSIT (by either use of our FREE Courier Service or FREE Send Service) they will be processed by our Quality Assessment Team when they reach us and you are unable to cancel this transaction or order once your items have commenced Transit.

Upon inspection of your items, if we find any item(s) that we believe to be counterfeit, fake, imitation, an illegal copy or a non-original product we will dispose of these at our sole discretion. All such counterfeit, fake, imitation items or illegal copies will not be paid for, will not be returned and we may report such incidents to the relevant authorities. By agreeing to these Terms and Conditions to expressly warrant that the products you sell to us are wholly original and not counterfeit, imitation or fake. No further discussion on the establishment of whether items are, including but not limited to, original, genuine, or counterfeit, fake, imitation, an illegal copy or a non-original product will be entered into by us. You understand, agree and accept that the determination as to the originality of the items/products, that you wish to sell to us, is at our sole discretion. You hereby indemnify us against any loss or claim whatsoever and howsoever arising from us grading, inspecting, assessing and/or reviewing your products/items and the outcome of our grading process, inspection, assessment, quality checking and/or reviewing is that your item(s) are determined by us, at our sole discretion, to be non-original, a copy, fake, an imitation or a counterfeit in our opinion.

For items that are sent to us, but have not been valued by us, which means you have been provided by us with a valid, as solely determined by us, ‘offer price’ via our webservice(s), website(s) or mobile application(s); or where the valuation process has occurred and we have not actually offered a ‘price’; and/or they do not appear in a valid musicMagpie order/transaction item list, you understand, accept and agree that we will not pay you for these items and are unable to return them, but will where possible recycle them responsible otherwise if due to the nature of the item or the cost of recycling, dispose of them responsibly.

You accept and agree that when creating a single Order with musicMagpie you cannot sell multiples of the same product(s) and that you will not attempt to create multiple Orders in order to sell multiples of the same product(s) to us without our express permission. The order minimum and maximum item limits and/or requirements are posted on our webservice(s), website(s) or mobile application(s) and form part of these Terms and Conditions and musicMagpie reserves the absolute right to vary these from time to time at its sole discretion.

musicMagpie reserves the absolute rights to close your account and cease dealing with you at its sole discretion and for reasons it determines.

Your statutory rights are not affected.

Items that you sent to us by mistake

Please check the items you are sending to us before you package and send them to make sure that you only send us items that we accept. If for any reason you include items we do not accept with your order: for example, if you leave an item in the pocket of a coat you are selling to us or something inside one of the media cases of the DVDs you selling to us, if we find these items we will dispose of them responsibly and they cannot under any circumstances be returned. You hereby accept and agree to hold us harmless and full indemnify us against any loss material or otherwise that you may suffer due to disposal of these unaccepted items by us and/or our partners or affiliates.

Selling CDs, DVDs, Blu-Rays & Games

All CDs, DVDs, Blu-Rays and Games sold to us are checked by our quality control team during our quality assessment process. musicMagpie will not make payment for, or return to the sender/seller/user any CDs, DVDs Blu-Rays or Games delivered in the following condition:

· If ANY of the original disks from the original item are missing.
· If the disk in the case does not match the cover and / or sleeve notes.
· If some, or any, of the cover and / or sleeve notes are missing.
· If the cover and / or sleeve notes OR the disk are irretrievably damaged and cannot be refurbished e.g. the disk is cracked or very badly scratched or the cover and / or sleeve notes are water damaged, ripped or torn.
· If the cover, the disc artwork and/or the sleeve notes are defaced in any way.
· If musicMagpie suspects the product is 'non original' in any way. Please note, this matter is taken very seriously and musicMagpie reserves the right to take further action as appropriate regarding ‘non original’ recordings or fakes. Please see the conditions given herein these Terms and Conditions for more information about users sending or attempting to sell non-original, counterfeit or fakes to us which can be found in the section of these Terms and Conditions entitled ‘Selling Your Stuff – General Conditions’.
· If the barcode you entered on our website(s), mobile applications or online valuation systems for valuation is NOT identical and/or evident on the cover, disc artwork and/or sleeve notes of the item received.
· If no barcode is present we reserve the right to reject the item.
· If when quality assessed by our team we find that the CD you have sent to us and/or valued on our site, is in fact not a CD album but a CD single we reserve the right to fail that item and under our Terms and Conditions deal with that item as we do with all items that fail quality assessment.
· If any Game does not have all the original instruction booklets in addition to the original art work.

Where CDs, DVDs, Blu-Rays and games are rejected for any of the above reasons, musicMagpie’s decision is final. Users will be kept informed via email updates and by us providing updates to the relevant transaction within their musicMagpie online account, if one or more of their items have failed quality control.

· If any Game is sent to us that is of a format that we do not accept which is described below:

We only accept Games on the following formats: Playstation 2, Playstation 3, Xbox, Xbox 360, Nintendo Wii, Nintendo DS, Nintendo 3DS, PSP and PS Vita. Individual Games on these formats will be accepted by title, and not all game titles will be accepted, regardless of whether they are on an accepted format. For clarity we DO NOT accept PC Games.

For CDs, DVDs, Blu-Rays and games the prices offered to you by us are valid for six (6) months from the date that they are offered to you and you complete a valid transaction on our webservice(s), website(s) and/or mobile application(s) and after that period you understand, accept and agree that should we not process your items at our warehouse within the period (six (6) months) that the offer price is valid, that we may revalue your items. In the event that we do have to revalue your items, you hereby understand and agree to the ‘new offer prices’ following the revaluation, as determined by us at our sole discretion, and that we will process your items and your payment in accordance with the ‘new offer prices’ only. We will contact you, usually, via email in the event that this happens.

Selling Tech & Electronic Products

All tech & electronic products sold to us are checked by our quality control team or a quality control team of one of our nominated partners during the quality assessment process. If your tech and/or electronic product(s) fail our quality assessment process it will be because the item that you have sent to us is NOT as you have described it when entering the details (providing the required information as prompted by us) of this item on our webservice(s), website(s) and/or mobile application(s) and therefore the information you have provided during the selling process to us does not match that gathered by our quality control team when reviewing the tech and/or electronic product(s) that you have sent to us.

Each tech and/or electronic product(s) that you sell to us should match, where applicable, and, including but not limited to the, make, model, size, colour and condition that you ascribe it when using our webservice(s), website(s) and/or mobile application(s) to sell your tech and/or electronic product(s) to/on musicMagpie. When we quality assess your tech and/or electronic product(s) at our warehouse, or in a place nominated by us solely, we will use the Condition Specifications given below, which were presented to you on our webservice(s), website(s) and/or mobile application(s) when you described the condition of the item to make sure that the tech and/or electronic product(s) you sent to us is as you described it on our webservice(s), website(s) and/or mobile application(s) when deriving a musicMagpie valuation/offer price for the item(s) you wish to sell. The Condition you described the tech and/or electronic product(s) to be in, when selling your tech and/or electronic product(s), to us on our webservice(s), website(s) and/or mobile application(s) directly affects the price we offer for it and if we determine the condition to be different from that which you described we may offer you a revised valuation. Details of what happens when we offer a revised valuation for tech and/or electronic product(s) are contained within these Terms and Conditions.

If your tech and/or electronic item(s)/product(s) fail our quality assessment process we will contact you via email and inform you of the new valuation we have determined for the item(s) you have sent us. You have four (4) days known as the ‘Grace Period’ to accept or decline the revised offer price/valuation we have provided to you on email. In this email you will be provided with the option to ‘Accept’ or “Decline’ our revised offer price/valuation.

If you accept the revised valuation, the new price agreed between you and musicMagpie for the item will be updated in the relevant order, we will present this information to you in the “my account” section of musicMagpie.co.uk and when processing your payment for the relevant order this revised valuation will be the new price paid for that specific tech and/or electronic item(s)/product(s). The revised valuation is the last and only price we will offer you for the tech and/or electronic item(s)/product(s) in question.

If you take no action and do not respond to this revised valuation email correctly within the four (4) day Grace Period (four (4) day period will begin from 9:00hrs on the day the email is sent to you and end 96 hours later) then we will automatically process payment for the tech and/or electronic item(s)/product(s) at the revised valuation price we have sent to you.

If you choose to decline the revised valuation offered within the four (4) day Grace Period when the revised valuation was offered then you may request that your items are returned to you. The cost for returning any item to you is a minimum charge of £15.00 and a maximum of £50.00 subject to the type of item you wish to be returned and as solely determined by musicMagpie. You will be advised of the actual charge for return of your specific item by email once you have decided to decline the offer. You understand and accept that we must receive cleared funds from you prior to dispatching the item you wished to be return.

You expressly accept and wholly agree that ANY declination by you of the revised valuation/revised offer price AFTER the four (4) day Grace Period is invalid. By this time you will already have automatically accepted the revised offer price as per the conditions set forth in these Terms and Conditions. You accept and agree that musicMagpie is not liable in anyway whatsoever for any compensation of any kind, loss of any kind if you fail to act within the four (4) day Grace Period and ‘Accept’ or “decline’ the revised offer and you also agree and accept that the revised offer price made by us to you is the final price we will pay you for the item. In this/these instances the tech and/or electronic item(s)/product(s) will not be returned and you will be paid the revised valuation for the tech and/or electronic item(s)/product(s) and the tech and/or electronic item(s)/product(s) will not and cannot be returned to you in this instance.

You understand, accept and agree that musicMagpie’s valuation of the item is final and no discussions will be entered into regarding the value we place on the item(s) once it has been through our quality assessment process.

We recommend that you delete ALL and/or any personal information (“Data”) that is or maybe stored on your tech and/or electronic item(s)/product(s) such as, but not limited to, digital images/pictures, contact information, usernames, passwords, internet browsing history, settings, songs, mp3s, videos, games. You hereby agree to release and indemnify musicMagpie from all and any losses, claims or damages with respect to the tech and/or electronic item(s)/product(s), data stored or contained therein or on any media storage device or media that has, maybe or is used in conjunction with the devices including, but not limited to, SIM or SD cards. We accept no responsibility whatsoever in relation to the data that you may, whether knowingly or unknowingly, have provided, whether personal, confidential, private or otherwise your own on the tech and/or electronic item(s)/product(s) because of action taken whilst it was in your possession, to us when selling your tech products and furthermore we take absolutely no responsibility for the security of such or any data that reaches us as a result of the sale of your tech and/or electronic item(s)/product(s). You accept that it is entirely your own responsibility to remove such data from the tech and/or electronic item(s)/product(s) prior to sending it to us. We provide a free online guide explaining how to delete personal data from your tech products, which we recommend that you read if you need help deleting such data from your tech and/or electronic item(s)/product(s).

We take no responsibility whatsoever and you are fully responsible for cancelling any contracts linked to the tech and/or electronic item(s)/product(s) that you sell to us including, but not limited to, airtime contracts, call or data charges arising before or after we have received your tech and/or electronic item(s)/product(s) or that may arise anytime, or under any circumstances whatsoever.

Please be sure to remove any and all SIM, media storage / memory cards from your tech and/or electronic item(s)/product(s) prior to sending them to us. If we discover on receipt/reviewing your tech and/or electronic item(s)/product(s) that storage devices, SIM Cards, memory cards or similar devices have been sent to us we will NOT return them, they will be recycled/disposed of responsibly and we accept no liability for these items sent in error by you and furthermore we will not be liable and you agree to indemnify us completely for any charges incurred as a result.

For tech and/or electronic item(s)/product(s) that we accept, the prices offered to you are valid for twenty one (21) days from the date that they are offered to you and you complete a transaction on our webservice(s), website(s) and/or mobile application(s) and after that period (twenty one (21) days) you understand, accept and agree that should we not process your items at our warehouse within the period that the offer price is valid that we may revalue your items and if we do and email you the revised offer price then you will be deemed to be at the start of the four (4) day Grace Period and the Terms and Conditions set forth herein and without question apply to you, your transaction and your tech and/or electronic item(s)/product(s) as such.

Selling Clothes

All clothing garments sold to us are checked by our quality control team during our quality assessment process.

Clothing garments that you sell to musicMagpie must be:

Accurately Described by the user and Accepted by our Valuation Engine
In Good Condition
Wholly Original i.e. not counterfeit, fake or a copy
As per the original production and/or design for that garment

Please note the above list of conditions is not exhaustive and the garments or garment conditions we accept is not limited to that list. Garment Types that we ACCEPT

We accept a wide range of garment types, clothes made from different materials and styles and what we accept may change from time to time at our sole discretion. We only accept garments where the Description you enter on our webservice(s), website(s) and/or mobile application(s) in our Valuation Engine returns an Offer Price and where that garment's description which you have provided via webservice(s), website(s) and/or mobile application(s) is matched to the Actual Description we generate for that garment once we have received that garment at our warehouse as part of a valid Order and assessed by our quality assessment team. No other items will be accepted by us under any circumstances. We may or may not choose to limit the items of clothing by brand or any other criteria that we do allow you to sell using musicMagpie from time to time, without notice and at our sole discretion. To sell clothes to musicMagpie your must ensure that you Accurately Describe the item when entering its details into our Valuation Engine and retrieving an 'Offer Price' (Offer Price in this Agreement means the value in Sterling (GBP) that musicMagpie will pay you, subject to these Terms and Conditions only, for the item and is provided in your Order/Transaction Information at item level once you have completed your order or in your 'Basket of Goods' when creating an Order). Any inaccurate descriptions may generate an inaccurate item description and in turn an invalid and void offer price. If items are found upon quality assessment and inspection by us to have been inaccurately described we expressly reserve the absolute right, at our sole discretion and without question to a) withdraw our offer for the inaccurately described garment, b) revalue the garment according to its 'Actual Description' (which in these Terms and Conditions shall expressly and only mean, the description, type or type of garment that we alone find the garment to be (including but not limited to the garments brand, size, make, model, design, cut, style and or apparel type) or c) reject the item as one we do not accept based on the 'Actual Description' that we find the item to be in or the condition in which the garment has been provided. For more information about revalued garment and rejected garments please see the section of these Terms and Conditions entitled Garment Conditions and Garment Types we DO NOT accept".

For clothes the prices offered to you by us are valid for two (2) months from the date that they are offered to you and you complete a valid transaction on our webservice(s), website(s) and/or mobile application(s) and after that period you understand, accept and agree that should we not process your items at our warehouse within the period two (2) months that the offer price is valid, that we may revalue your items. In the event that we do have to revalue your items, you hereby understand and agree to the 'new offer prices' following the revaluation, as determined by us at our sole discretion, and that we will process your items and your payment in accordance with the 'new offer prices' only. We may contact you, via email in the event that this happens.

Garment Conditions and Garment Types we DO NOT accept.

musicMagpie will not make payment for, or return to the sender/seller/user/customer any clothing garments received and/or assessed by us once received (including but not limited to our quality control team) in, or under, the following condition(s):

If the item is not in GOOD CONDITION; where 'Good Condition' means the garment in its entirety is in such a condition that it would appear to have been worn or used a couple of times since being purchased as new and there are no strains, stains, rips, broken stitching, damage that would materially affect or tears to, the garments' material/fabric, pattern, colouring, cut, style, or original design. Please note that where some of these garment conditions e.g. tears or rips make up the original design of the garment and were part of the original production, at musicMagpie's sole discretion which shall be without question, we may choose to accept these items with these conditions.
Missing, incomplete, altered, tampered with, defaced, personalised, repaired or broken elements which are an intrinsic part of the garments original design and/or original production, including but not limited to labels, branding, zips, buckles, buttons, belt rings, fastenings of any other type i.e. velcro, clips, poppers or any other fasteners that should be present due to the garments original production and/or design.
Any garments where ANIMAL HAIR is found to be present either in or on the garments material and/or fabric in any quantity whatsoever.
Any garments with any EXCESSIVE STAINS/MARKS and/or materially damaging irremovable or unsanitary stains/marks/blemishes from products or events including, but not limited to; burns of any type, ash, fake tan, anti-perspirant, deodorant, perfume, perfume(d) oils, moisturisers and/or creams, dirt, water damage, damp, mould, fungus, blood, mud or paint.

Please note the conditions for selling garments to musicMagpie and the descriptions of the items we do not accept are not exhaustively listed herein these Terms and Conditions and that the quality assessment of items/garments is finally performed to provide a quality judgment by us and our quality assessors. What we determine to be in 'Good Condition' and or the 'Actual Garment Type' of your items/garment/products and the resulting valuation is at our sole discretion and by accepting these Terms and Conditions you understand, accept and agree that musicMagpie's assessment is final, without question and no discussion shall be entered into.

In the event that we find the Actual Description of the garment/product/item differs from that which you have provided when describing the garment on our webservice(s), website(s) and/or mobile application(s) during the selling process we may revalue your item in accordance with the Actual Description and where this new valuation/new Offer Price if different, by accepting these Terms and Conditions you agree and accept that the new valuation (new Offer Price) will be the amount you will accept and receive for that item as part of your transaction/Order with musicMagpie. Where we find the Actual Description of the garment is for a garment that we DO NOT accept then you accept and agree that no Offer Price will be generated by the revaluation of that garment, no monies will become due for that garment and that it will be recycled by us at our cost. You expressly understand, accept and agree that in no circumstances whatsoever (other than those required of us by law) will we return revalued garments or garments that are not accepted by us.

If musicMagpie suspects the product is 'non original' in any way. Please note, this matter is taken very seriously and musicMagpie reserves the right to take further action as appropriate regarding 'non original' recordings or fakes. Please see the conditions given herein these Terms and Conditions for more information about users sending or attempting to sell non-original, counterfeit or fakes to us which can be found in the section of these Terms and Conditions entitled 'Selling Your Stuff – General Conditions'.

Special Condition F1

For items that our quality assurance team assess as not in a Condition we accept, at our sole and complete discretion, we may choose to accept an item subject to a reduction in the price offered for it. We are under no obligation whatsoever to accept any items that do not meet our Condition criteria as defined by us only. You expressly accept and agree that any offer made for any item of Clothing that do not meet our acceptance Condition(s) by us, to you, is accepted by you without question. We will make such offers after assessment of your items only and update your Order Information accordingly by marking the items as revalued and provide the new price paid for the item which is accepted by you, without question.

Registered Stolen or Lost Tech Products

Sending your items to us is FREE using our FREE Send or FREE Courier Service

musicMagpie offers customers a number of ways to send your items to us for FREE. They include using:

• Our FREE Fully Insured Courier Service, which is offered to customers who sell more than 25 items and/or a single Tech item or where the items the customer is selling is judged by our Clever Box Calculator to be only valid for transit using our FREE Courier Service. • Our FREE Send Service, subject to these Terms and Conditions and is offered to customers who sell 10 or more, to a maximum of 500 items per order BUT do not include a Tech item in their order.

Please note that customers will be provided with proof of postage when using our FREE Send Service and you should keep this for your records..

You understand, accept and agree to ONLY use musicMagpie's FREE Courier Service or FREE Send Service for items that you are selling to musicMagpie. Any other use of these services is forbidden and should you use or attempt to use our FREE Courier Service or FREE Send Service for items other than those which you are selling to musicMagpie you may be charged for use of this service as determined by the costs administrative and/or actual as determined at musicMagpie's sole discretion.

To ensure payment is made quickly users are recommended to send their items in as few parcels as possible. All parcels must be secured properly and appropriate packaging should be used. The number of parcels that you will need to use to send us your items using our FREE Send Service and/or FREE Courier Service are provided by our Clever Box Calculator. Our Clever Box Calculator provides you with a list of items for each individual box you need to send, whilst maintaining the weight limits applied by partner companies that you are required to adhere to in order to have your parcels accepted by them for return to us. You must follow the guidance of our Clever Box Calculator when sending us your items. Full details are provided in your Welcome Pack, which is emailed or posted to you when you complete a transaction.

You must ensure that when sending your items to us you attach the correct label(s) to each package. The label you require for each package is provided to you both in your Welcome Pack and on our website. You need a unique label for each parcel that you send to us and these can be downloaded from our website(s) in the My Account section. You must follow the in packaging instructions you are provided with in your packaging guide. You must affix a valid label to each and every package/ parcel that you wish to send to us using our FREE Send Service or FREE Courier Service.

Please note that if you are selling Tech Products as part of your transaction we only offer FREE Courier Collection Service for these types of transactions and you may not send orders that contain tech products to us via any other postal services at this time. Our FREE Courier Service allows the items to be sent to us, to be insured up to the value we have placed on the items, which is described item-by-item, in the associated Welcome Pack of the order you are sending to us. No other valuations will be accepted other than that of musicMagpie for these insurance purposes please refer to our FREE Courier Terms and Conditions for full details. All and any use by you of our FREE Courier Collections Service is subject to our FREE Courier Terms and Conditions, which make up part of these Terms & Conditions. All and any use by you of our FREE Send Service, which we provide to our customers in association with Drop & Collect Limited T/A Collect Plus (Collect+) is subject to our FREE Send Service Terms and Conditions, which also make up part of these Terms & Conditions. You accept and agree that musicMagpie may, at any time and its sole discretion, alter the valid returns/transit/delivery service it offers to you for the items you wish to sell.

Getting Paid

Payment Methods available to you are bank transfer (BACS) or cheque, unless you have selected to donate the proceeds of your sale to one of our named charities or chosen to receive your payment in e-Vouchers from our selected list of e-Voucher suppliers and no other alternatives are available.

Once you have selected a payment method for a particular order this is not changeable and it is your responsibility to ensure that the Payment Details including but not limited to, for example; Account Holders Name, Account Number and Sort Code are correct and accurate. You may update these Payment Details (for clarity, you may NOT update the Payment Method once you have completed a transaction/order) in the My Account section of the website and it is your responsibility to do so. We may prompt you either via our website(s), mobile applications or via electronic mail or post from time to time and ask you to check that the Payment Details you have provided are correct and accurate. Such communications or prompts of this type from us to you, do not mean that we assume any responsibility whatsoever for the validity of the details that you submit/provide and it remains your sole responsibility to ensure that the Payment Details you have provided and/or are given in Your Account are correct, complete and accurate. We will not be liable if you fail to receive a payment or suffer any loss, including but not limited to, if a payment is sent to an incorrect account or recipient, as a result of any failure by you to correctly, completely and accurately provide and/or submit all Payment Details required when using our website(s) or mobile applications as instructed by us from time to time. You understand, agree, accept and that some of the Payment Methods made available to you depend on third parties (third parties that/who we cannot and do not control) to process these payment including, but not limited to, payments by bank transfer (BACS). We will not be liable for delay in receipt of payment as a result of the actions or inactions taken by such third parties. Payments may be subject to validation and security checks that we may or third parties may require at our/their discretion from time to time.

If you choose to donate the proceeds of your sale to one of our chosen charities, upon completing your sale by clicking the "complete trade" button and being presented with the confirmation page, you will not be able to change the payment method you have selected. The funds will be paid to the charity selected in accordance with our Agreement with that individual charity. Your statutory rights are not affected.

If you have chosen to receive the proceeds of your sale in e-Vouchers, by selecting an e-Voucher type/brand/provider when completing your transaction/order, then you will be asked to agree to individual terms and conditions of use for the type/brand/provider of e-Vouchers that you have chosen to convert your proceeds into. The e-Voucher terms and conditions must be agreed to in order for you to choose this payment method. If you do not agree to the e-Voucher terms and conditions then you will be unable to redeem the proceeds of your sale in this way and will need to choose another payment method i.e. cheque, bank transfer or donate to charity. On completion of your transaction/order once you have selected e-Vouchers as a payment method you will be unable to change this payment type. Please note that if you are selling items in a single transaction that we value in excess (i.e. more than) £1,000.00 you will not be able to receive these funds in e-Vouchers, but you will be offered payment by cheque, bank transfer or the option to donate the whole amount to one of our chosen charities. musicMagpie reserves the right to change, remove, alter and/or amend its chosen charities and/or e-Voucher types/brands/providers at its sole discretion, subject to its Agreement with each charity and or e-Voucher provider.

It is the responsibility of the user to ensure that the registered name and address in their musicMagpie account is entered correctly and accurately. If your bank refuses to clear a cheque due to an error in the name or address details you have provided to us, musicMagpie reserves the right to make an administrative charge in the form of a deduction or a request for payment from you, for the reissue of payments. Please note that payment reissues are only made by BACS/bank transfer and you will be required to provide musicMagpie with your account details in order to reissue payment to you. It is at the sole discretion of musicMagpie how reissue payments are made. If you provide incorrect bank account details for reissue and a payment is refused by your bank upon applying for another reissue we may, at our discretion apply another administrative charge in the form of a deduction or a payment from you.

All payments include VAT at the current UK rate.

Use of musicMagpie

musicMagpie has been developed for use by members of the general public only and not by businesses, organisations, cooperatives or traders (whether sole, market or otherwise).

musicMagpie will automatically reject transactions which contain multiple items of the same CD, DVD, Blu-Ray and/or Game title and reject repeat transactions that contain the same CD, DVD, Blu-Ray and/or Game titles/items that have been traded before by a user. These CD, DVD, Blu-Ray and/or Game items will not be paid for, not returned and will be recycled responsibly. Only one account per person is allowed.

musicMagpie tries to ensure that any information provided is up to date and accurate, but we cannot be held responsible for goods offered through third parties. We will amend any inaccuracies or exclusions as soon as is practical once we have been made of aware of them.

musicMagpie shall not be liable for any special indirect, punitive, incidental, special or consequential damages relating to the participation or inability to participate in the programme.

musicMagpie is not responsible for damages or losses that result from participating or inability to participate in the offers whether affiliate or otherwise, or reliance on or use of information, services, or merchandise provided on our websites. The User acknowledges and agrees that musicMagpie neither endorses the contents of advertisements or third parties' websites, nor assumes responsibility or liability for the accuracy of material contained therein, or any infringement of third party intellectual property rights arising there from, or any fraud or other crime facilitated thereby.

musicMagpie is not responsible and assumes no liability for changes or discontinuances of service from providers which may affect offers. In no event shall musicMagpie’s liability, either jointly or severally, exceed £20. musicMagpie however does not limit its liability for death and personal injury resulting from its negligence.

You agree to indemnify and hold musicMagpie, its affiliates, officers, and employees harmless from any claim, demand, expense, or damage, (including reasonable legal fees) relating to your breach of this Agreement and your posting of any material on this site.

Users Agree and expressly Warrant that prior to selling their CDs, DVDs, Blu-Rays and/or Games that they have not "ripped", digitally copied or made any other type of illegal copy of the entertainment products that the User is selling and furthermore Agrees and Accepts to fully indemnify musicMagpie against any potential action or action(s) whatsoever that may or may not be taken with regard to the sale of their entertainment products in relation to, but not limited too, artist rights, copyright and/ or intellectual property that might or may result from the sale of the Users entertainment products to musicMagpie.

Transaction Times Guide

The following is offered as a guide only, for the timescale that the transaction will take to complete:

It can take 7-10 days for your items to reach us using our Free Courier Service or using our FREE Send Service.

We will then check your items against your order and ALL your items will go through our Quality Assessment Process as quickly as possible. At busy times this can take up to 7 days to complete.

Once all your items have passed Quality Assessment and your order is completed, payments will be processed as follows:

Cheques are dispatched via Business Post within 3 days of the completion of the Quality Assessment Process. Business Post can take up to 7 working days to deliver items and we will post your cheque to the address you entered into our website on registration. musicMagpie takes no responsibility for delays in receipt of payment due either to Business Post or incorrect/insufficient address details being entered onto the system by you.

Bank transfers are processed for payment in batches, once you have verified your bank details and these have passed to our payment system, payment is made within 3 working days from being processed through our system. When the funds are cleared and available to you in your bank account can vary depending on which organization/bank your account is held with.

If you have chosen to be paid by e-Voucher, we will usually email a valid e-Voucher code to you within 1 working day of informing you that your items have passed through our Quality Assessment Process. This notification is usually emailed to you.

If you have chosen to donate your items to one of our chosen charities, once your items have passed through our Quality Assessment Process we will email you to inform you of the total amount we will be paying to the charity partner you have selected on our website and pay them in accordance we our agreement with that charitable partner.

Please note that we will regularly communicate with you by email regarding the progress and status of each order or users may log onto their account and look into the order history for updates.
