Quality Assessment

Selling Tech Items

15.1 All Tech Items sold to us are checked by our quality control team during our Quality Assessment process.

15.2 Tech Items will automatically fail the Quality Assessment if the Item that you have sent to us is NOT as you have described it when you entered the details of this Item on the Website.

15.3 Each Tech Item that you sell to us should match, where applicable, and including but not limited to, the make, model, size, colour and condition that you select when using the Website to sell your Tech Item to us.

15.4 When conducting a Quality Assessment of your Tech Item we will use the Condition Specifications as updated from time to time which were presented to you on the Website when you described the condition of the Item in order to receive our Valuation. The Condition Specifications set out on the desktop and mobile versions of our website supersede all others, including those on our mobile applications, as those Condition Specifications found on our mobile applications may from time to time become dated due to new app versions releases. 15.5 The condition you described the Tech Item to be in, when selling it to us on the Website directly affects the price we offer for it and if we determine the condition to be different from that which you described we may offer you a revised valuation in accordance with the procedure below.

15.6 If you:

a) fail to send your Tech Items to us within twenty-one (21) days from the date that you place your order; and

b) we have not processed your Tech Items at our warehouse within the twenty-one (21) days from the date that you place your order,

we shall have the right, at our discretion, to revalue your Items.

IMPORTANT: Please Read Carefully

15.7 If your Tech Item fails our Quality Assessment process or we have the right to re-value your Item in accordance with condition 15.6, we will contact you via email and inform you of the new Valuation for the Item.

15.8 You have fourteen (14) days known as the ‘Grace Period’ to accept or decline the revised Valuation that we have provided to you on email. To be clear, this fourteen (14) day period begins when the revised valuation email is sent to you and ends 336 hours later.

15.9 In this email you will be provided with the option to ‘Accept’ or 'Decline’ our revised Valuation.

15.10 You must either accept or decline our offer by clicking the relevant button on the email and following the link within the Grace Period. Failure to do so within the Grace Period may result in us proceeding with your transaction at the revised Valuation. If you contact us during the Grace Period using another method we will try to update our system to record your decision but we cannot guarantee this.

15.11 During the Grace Period, we will send you regular reminders that you need to accept or refuse our proposal. If 24 hours before the end of the Grace Period, we have not received your acceptance or refusal of our offer under condition 15.10 above, we will make efforts to send you a final reminder before the Grace Period ends. This will not affect our rights under condition 16.10 above, however.

15.12 If you accept the revised valuation, the new price agreed between you and us for the Item will be updated in the relevant order, we will present this information to you in the “My Account” section of the Website and then process your payment for the relevant Item. This revised Valuation will be the new price paid for that Tech Item.

15.13 The revised Valuation is the last and only price we will offer you for that Tech Item.

15.14 If you choose to decline the revised Valuation offered within the Grace Period then we will return your Item to the address you have provided in your musicMagpie account at no additional cost.

15.15 If you take no action and do not respond to this revised Valuation email correctly within the Grace Period then we will automatically process payment for the Tech Item at the revised Valuation price we have sent to you. You accept and agree that we are not liable in any way whatsoever for any loss of any kind, direct or indirect which you may suffer as a result of your failure to act within the Grace Period and ‘Accept’ or 'Decline’ the revised Valuation.

15.16 In this instance the Tech Item will not be returned and you will be paid the revised Valuation for the Tech Item.

15.17 We assume no responsibility whatsoever for the validity of the details that you provide and it is your sole responsibility at all times to ensure that the Payment Details you have provided on the Website are correct, complete and accurate.

Selling Media Items

15.19 All Media Items sold to us are checked by our quality control team during our Quality Assessment process.

15.20 For Media Items, where your Items do not pass our Quality Assessment we will reject and make no payment for them and:

a) if our original Valuation for an individual Media Item was £15.00 or more, we will return the Item to you free of charge; and

b) for other Media Items, we will arrange for your Item(s) to be recycled.

15.21 If you have not sent your Media Items to us or arranged for our courier to collect your Media Items within twenty eight (28) days from the date that you place your order, we shall have the right, at our discretion, to reject and recycle your Items and make no payment for them.

15.22 IMPORTANT: except under the circumstances described in condition 15.23 below, we will not make payment for any Media Items which fail our Quality Assessment. Media Items delivered in the following condition will be deemed at our absolute discretion to have failed the Quality Assessment:

a) if ANY of the original disks from the Item are missing;

b) if the disk in the case does not match the cover or sleeve notes;

c) if some, or any, of the cover or sleeve notes are missing;

d) if the cover, sleeve notes or the disk are irretrievably damaged and cannot be refurbished e.g. the disk is cracked or very badly scratched or the cover, cardboard case or sleeve notes are water damaged, ripped or torn;

e) if the cover, the disc artwork or the sleeve notes are defaced in any way;

f) if we suspect that the product is 'non original' in any way;

g) if the barcode you entered on our website for valuation is not identical or evident on the cover, disc artwork or sleeve notes of the Item received;

h) if we find that the Item you have sent to us is in fact not a CD album but a CD single;

i) if any game does not have all the original instruction booklets in addition to the original art work; or

j) if a game is sent to us in a format that we do not accept. For the avoidance of doubt we only accept games on the following formats: Playstation 2, Playstation 3, Playstation 4, Playstation 5, Xbox, Xbox 360, Xbox One, Xbox Series X|S, Nintendo Switch, Nintendo Wii, Wii U, Nintendo DS, Nintendo 3DS, PSP and PS Vita. Individual games in these formats will be accepted by title, and not all game titles will be accepted. For clarity we DO NOT accept PC games.

15.23 We will not reject CD singles under condition 15.22 above where you have sent them to us in the legitimate belief that they are CDs and we have provided you with a Valuation for the CD single.

15.24 Where Media Items fail the Quality Assessment our decision is final.

What happens if your Media Item fails the Quality Assessment?

15.25 Any Media Item with an original valuation under £15.00 which fails the Quality Assessment cannot be returned to you under any circumstances and will be recycled responsibly by us. You will not receive any payment for that Media Item. If a Media Item fails the Quality Assessment we will inform you via email once your order has been processed.

15.26 If you send a Media Item to us which was not included in your order (whether knowingly or unknowingly), this will also be deemed to automatically fail a Quality Assessment and we will dispose of the Item responsibly. We will not under any circumstances return such an Item to you or provide any payment which had not already been agreed.

15.27 By placing an order on the Website you consent to us dealing with your Media Item in this way and agree that this will constitute sufficient payment for your Item.

15.28 We shall not be responsible for any loss, material or otherwise, that you may suffer due to disposal of these unaccepted Items.

Selling Books

15.29 All books sold to us are checked by our quality control team during our Quality Assessment process.

15.30 Where any books do not pass our Quality Assessment we have a right to reject and recycle your Items at our discretion and make no payment for them.

15.31 If we have not processed your books at our warehouse within the twenty eight (28) days from the date that you place your order, we shall have the right, at our discretion to reject and recycle your Items at our discretion and make no payment for them.

15.32 IMPORTANT: we will not make payment for, or return to you any books which fail our Quality Assessment. Books delivered in the following condition will be deemed at our absolute discretion to have failed the Quality Assessment:

a) if there is substantial damage to the front cover of the book. Please note that “substantial damage” is completely at our discretion;

b) if an Item is not that which was submitted upon the completion of your trade. We accept all books using the ISBN number which identifies each Item;

c) if there are any missing, damaged or defaced pages. This includes those pages with annotation, highlighting or written notes/drawings of any kind;

d) if there is visible damage or discolouration to the pages/cover of the book caused by liquid, mould or deterioration over time;

e) if the Item was originally supplied with any kind of cover for protection against damage/dust and this is absent when we receive the Item;

f) if we suspect that the Item is 'non original' in any way;

g) if the ISBN barcode number you entered on our website for valuation is not identical or evident on the cover, front or back, of the Item received; or

h) if there is significant damage to the corners/edges of the Item that has been sent to us.

15.33 Where any books fail the Quality Assessment our decision is final and the Items will not be returned.

What happens if any of your books fail the Quality Assessment process?

15.34 Any books which fail the Quality Assessment cannot be returned to you under any circumstances and will be recycled responsibly by us. You will not receive any payment for that Item. Any rejections will be visible in the 'My Account' section.

15.35 If you send a book to us which was not included in your order (whether knowingly or unknowingly), this will also be deemed to automatically fail Quality Assessment and we will dispose of the Item responsibly. We will not under any circumstances return such an Item to you or provide any payment which had not already been agreed.

15.36 By placing an order on the Website you consent to us dealing with your books in this way and agree that this will constitute sufficient payment for your Item.

15.37 You accept and agree to hold us harmless in respect of any loss, material or otherwise, that you may suffer due to the recycling of Items which fail our Quality Assessment.

Selling LEGO®

15.38 All LEGO® sold to us is checked by our quality control team during our Quality Assessment process.

15.39 IMPORTANT: we will not make payment for any LEGO® which fails our Quality Assessment. LEGO® will be deemed to have failed the Quality Assessment:

a) if the LEGO® in your order is damaged. This includes LEGO® that is chewed, discoloured or warped. Please note that the definition of “damaged” is completely at our discretion; or

b) if the LEGO® in your order isn't authentic or original (i.e. a different brand such as Mega Bloks or K-NEX).

Your LEGO® will be weighed again with blocks that have failed removed, and we may revise your payment based on the new weight.

Revised Valuations for LEGO® Items

15.40 If your LEGO® order weighs less than originally described (either because the amount received is less than originally described or where we have removed blocks which have failed our Quality Assessment) we will revise the value of your payment according to the actual weight. We will contact you via email and inform you of the new Valuation for your Item.

15.41 You have fourteen (14) days known as the ‘Grace Period’ to accept or decline the revised Valuation that we have provided to you on email. To be clear, this fourteen (14) day period begins when the revised valuation email is sent to you and ends 336 hours later.

15.43 During the Grace Period, we will send you regular reminders that you need to accept or refuse our revised Valuation. If 24 hours before the end of the Grace Period, we have not received your acceptance or refusal of our offer under condition 15.42 above, we will make efforts to send you a final reminder before the Grace Period ends. This will not affect our rights under condition 15.42 above, however.

15.44 If you take no action and do not respond to this revised Valuation email correctly within the Grace Period then we will automatically process payment for the LEGO® Item at the revised Valuation price we have sent to you. We will not be liable in any way whatsoever for any loss of any kind, direct or indirect which you may suffer as a result of your failure to act within the Grace Period and ‘Accept’ or 'Decline’ the revised Valuation.

15.45 If you accept the revised Valuation, the new price agreed between you and us for the Item will be updated in the relevant order. We will present this information to you in the “My Account” section of the Website and then process your payment for the relevant Item. This revised Valuation will be the new price paid for that LEGO® Item.

15.46 The revised Valuation is the last and only price we will offer you for that LEGO® Item.

15.47 If you reject our revised Valuation, we will send your LEGO® Item back for FREE. We will also return to you for FREE any blocks which fail our Quality Assessment under condition 15.39.

Selling Clothes

15.48 All clothes go through quality assessment by our quality control team. We buy clothes and trainers in the following conditions:

Clothes

Excellent

  • Clean – give them a wash before you send
  • Hardly worn item that may show imperfections but no stains, rips or holes
  • No missing buttons or broken zips

Good

  • Clean – give them a wash before you send
  • Lightly worn item with imperfections but no stains, rips or holes
  • No missing buttons or broken zips

We do not accept kids' clothes at this stage. Please do not send any as we can't return them.

Trainers

Excellent

  • Clean – give them a wipe and remove any dirt before you send
  • Hardly worn item with no marks, stains, rips, holes and not misshapen or dirty
  • Sole fully affixed (not detached or partially detached)
  • No discolouration or fading
  • No missing laces

Good

  • Clean – give them a wipe and remove any dirt before you send
  • Lightly worn item that may show minor marks but no stains, rips, holes and not misshapen or dirty
  • Sole fully affixed (not detached or partially detached)
  • No discolouration or fading
  • No missing laces

musicMagpie will not make payment for, or return, any clothes that fall into the following categories:

  • Ripped, torn or damaged
  • Below the condition standard chosen when selling
  • Incorrect brand
  • Counterfeit

We do not accept kids' trainers at this stage. Please do not send any as we can't return them.

15.49 All rejected clothes will be recycled responsibly (with the exception of items where our original valuation was over £15, which will be returned). 

15.50 All valuations offered for clothes are valid for 28 days from the completion of your order. If we do not receive your items at our warehouse in this timeframe, we reserve the right to process your items at a different valuation.

15.51 If your items are revalued, completing an order means you understand and agree that we will process your items and pay at the new valuation. We’ll contact you via email if your items are revalued.
